This Cookie Policy (hereinafter “the Policy”) supplements the Privacy Policy of the LOVALLY app. Its purpose is to provide you with transparent information regarding the use of cookies and trackers employed in connection with the LOVALLY app (hereinafter “the App”) and the LOVALLY website.

A cookie is a small text file stored on your device (computer, tablet, smartphone) when you visit a website or use an app. It allows information relating to your browsing to be stored and enables you to be recognised on subsequent visits.

The trackers used within the App work in a similar way to cookies and perform equivalent functions, particularly for technical and analytical purposes.

The data controller for the data collected via cookies and trackers is LOVALLY SA, a public limited company under Belgian law, registered with the Brussels Trade Register under number 1029.842.763, with its registered office at BE-1000 Brussels, avenue de Vilvorde 100.

4. Legal basis for processing

In accordance with the General Data Protection Regulation (GDPR), Directive 2002/58/EC (the “ePrivacy Directive”) and the Belgian Law of 13 June 2005 on electronic communications, the placement and reading of cookies are based on the following legal grounds:

Strictly necessary cookies: LOVALLY’s legitimate interest (Article 6(1)(f) of the GDPR) and the exemption from consent provided for by the ePrivacy Directive (as these cookies are essential for the provision of the service requested by the user);
Analytical and marketing cookies: user consent (Article 6(1)(a) of the GDPR), obtained prior to the placement of cookies.

5. Managing your consent

When you first visit the LOVALLY website, a cookie information banner will appear. This banner allows you to accept or refuse the placement of non-essential cookies (analytical and marketing).

You can also change your preferences at any time by accessing the cookie management settings available on the website or in the App settings.

Refusing analytical and marketing cookies does not affect the basic functioning of the App or the website.

8. Data transfers outside the EEA

Certain third-party cookies may involve the transfer of data outside the European Economic Area (EEA). Where applicable, such transfers are subject to appropriate safeguards in accordance with applicable regulations, such as the standard contractual clauses adopted by the European Commission or an adequacy decision.

9. Cookie retention period

The retention period for each cookie is set out in the tables in Article 3 of this Policy. Once their retention period expires, cookies are automatically deleted from your device.

Session cookies are deleted as soon as you close your browser or the App.

In accordance with the GDPR, you have the right to access, rectify, erase, restrict processing, data portability and object to the processing of data collected via cookies.
