LOVALLY PRIVACY POLICY

This is the privacy policy of LOVALLY. It aims to inform you about the use of your personal data when you use our homonymous application (hereinafter referred to as the "Application"). We invite you to read the following lines carefully.

LOVALLY places particular importance on the protection of your personal data and the respect of your privacy.

This Privacy Policy (as well as our Cookie Use Charter) aims to inform you how we process the personal data that you provide to us or that we collect as part of your use of the Application and our services.

This Privacy Policy applies to all services provided by LOVALLY that you use (excluding services provided and operated by third parties, which are subject to the third parties' own privacy policy, and not to these provisions).


1.         Who is responsible for processing your personal data ?

The data collected when you use the Application is processed by LOVALLY, which is the trade name of LOVALLY, a Belgian public limited company registered with the Brussels registry of legal entities (RPM) under number 1029.842.763, and whose registered office is located at BE-1000 Brussels, avenue de Vilvoorde 100.

2.         What data do we collect ?

When you use the Application or when you communicate with LOVALLY, we collect and process personal data concerning you.

This data may be provided directly by you or collected automatically by LOVALLY during your use of the Application.

Here is an overview of the personal data collected and processed by LOVALLY concerning you:

  • Traffic data (technical data related to communications) ;

  • Text messages sent and received ;

  • Enhanced identification data (national registration number, last name, nationality, official ID number), used for profile verification in case of suspicion or report concerning identity theft or fictitious or erroneous information (subject to your explicit consent) ;

  • Data related to participation in games, contests, testimonials, or satisfaction surveys.


Optional data:

  • Interests, lifestyle, and other characteristics.


2.1.                  Data that you provide us directly

By using our services, you directly provide us with data related to your registration and your interactions with LOVALLY.

Some of this data is visible to other users and is therefore made public on the Application. This information is accompanied below by the label "public".

Other data, on the other hand, is not visible to other users on the Application. This data is accompanied below by the label "private". 

LOVALLY cannot be held liable under any circumstances for the data that you have disclosed and made public on the Application.

2.1.1.         Data related to registration and your profile

Information required for registration

This data is essential to access our services. It is collected by LOVALLY based on the chosen registration method:

  • Registration via an Apple or Google account: by clicking on the "Log in with Apple or Google" button, you authorize the transmission of certain data to LOVALLY, in order to simplify the registration process ;

  • Registration via email address: in this case, you directly communicate your data to LOVALLY.


Some data is mandatory to access our services. Otherwise, your registration on the Application and the creation of an account will not be possible. The following are mandatory in all cases:

  • Your first name (public) ;

  • Your age (public);

  • Your date of birth (private) ;

  • Your gender (public),

  • At least three and a maximum of four profile photographs containing a face. You can add or remove photographs at any time, provided that at least three face photographs are retained (public) ;

  • Search preferences (age range, gender, and distance of the people you wish to meet) (private).


Verification of your identity and age by Yoti

In order to ensure the verification of your identity and age (which leads to the certification of your profile), we use the Yoti Identity Verification tool, developed by Yoti Limited (UK), whose registered office is located at 6th Floor, 107 Leadenhall St, London, EC3A, 4AF, United Kingdom.

When you register on the application, you will be invited to complete a verification process performed directly on Yoti's secure interface. This process aims to:

·      Verify your identity (name, first name, date of birth, etc.);

·      Confirm that you meet the age requirement to use the services offered by the Application.

In this context, Yoti may ask you to provide:

·       An official valid ID (identity card, passport, driver's license, etc.)

·       A photographic proof (selfie or video) allowing a biometric comparison with the document submitted.

The identification data thus collected and processed are done directly by Yoti, which acts as the data processor for this specific purpose. LOVALLY does not have access to complete information or documents submitted to Yoti in the context of this process.

You are invited to consult Yoti's privacy policy (Privacy at Yoti • Yoti) for more information on the processing of your personal data.

Using the Application involves acceptance of this verification procedure, without which your registration will not be possible.

Optional information to complete your profile

This data is transmitted voluntarily, under your sole responsibility. They may be added later directly within the Application:

  • Interests, habits, hobbies, personal preferences, lifestyle, music, etc. (public).

LOVALLY does not encourage the communication of sensitive data in your description on the Application which is visible to other users. According to the General Data Protection Regulation (GDPR), sensitive data include, in particular, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, sexual life, or sexual orientation.

If you choose nonetheless to disclose this data via your profile, they will be considered as "clearly made public" by you, within the meaning of the GDPR.

2.1.2.         Data related to your interactions with LOVALLY

When you contact customer service, report another user, participate in contests or surveys, or exercise your rights regarding your personal data, LOVALLY may collect the following data: 

Data related to reports and requests addressed to customer service

This includes:

·       Date and time of the report or request ;

·       Reason for the report or subject of the request ;

·       Data related to the reported user ;

·       Proof of identity (upon exercising your rights). 

This data is collected and processed when you submit a request for assistance to our customer service, exercise your rights regarding your personal data, report a problem or another user. This information is necessary for the processing of a report or to respond to your requests. This information is also processed when a report is made about you. Indeed, LOVALLY has a legal obligation to receive reports from its users concerning content or behavior likely to violate our Terms of Service.

Data related to participation in games, contests, testimonials, and satisfaction surveys

This includes:

·       Information related to your participation ;

·       Responses provided ;

·       Satisfaction level, suggestions, testimonials.

This data is mandatory for you to participate in any games or contests organized by us. However, data related to your testimonials and feedback are optional. 

2.2.                  Data that we collect automatically

When you use our services, LOVALLY automatically processes information related to your activity on the Application.

2.2.1.        Data related to your activity

LOVALLY processes data necessary for the provision of its services. Without this data, certain functionalities of the Application could not be guaranteed.

The data concerned includes, in particular:

  • The registration date;

  • Connection dates;

  • Your online or offline status;

  • Interactions with other users (Likes, Matches, etc.);

  • Notifications received and your notification preferences.


2.2.2.        Geographical location

The main interest of LOVALLY lies in the possibility of physically meeting other users. For this purpose, the Belgian company Devside, one of LOVALLY's partners, collects your geographical location, but only with your explicit consent. 

An authorization is required to activate geolocation, allowing Devside to identify your location in relation to other users who are also geolocated. This data is collected regularly as part of the provision of the services offered by the Application, unless more restrictive settings have been defined on your device.

When two users are within the same geographic radius (according to the distance preferences they have indicated) and their profiles are considered compatible by the Application, their respective profiles then appear in their news feed.

Other users can never know your exact position. Only your approximate position is displayed.

You can withdraw your consent to geolocation at any time via your device settings. In this case, your news feed will no longer be updated, and you will not see new users.

2.2.3.        Text messages sent and received

The written messages you have sent or received via the Application :

  • Are only accessible to the users concerned and only involve them;

  • Are not transmitted to third parties, except upon judicial request and/or in accordance with applicable legislative or regulatory provisions.

 

With your explicit consent, these messages :

 

·       Are stored on the servers of Firebase, a platform developed by Google Ireland, Ltd., whose registered office is located at Gordon House, Barrow Street, Dublin 4, Ireland, one of LOVALLY's partners;

·       May be accessed by LOVALLY and its partners Devside and Firebase (Google).

 

2.2.4.        Search preferences

 

The Application allows you to configure your search preferences, such as:

 

  • The sought gender,

  • The age range,

  • The geographical distance in relation to you ;

 

These preferences influence the profiles visible in your news feed.

 

You can modify your search preferences at any time on the Application.

 

Setting the search criterion based on the sought gender requires prior consent to the processing of this data by LOVALLY.

 

2.2.5.        Technical data from your mobile or device

 

Technical data, such as server logs, are processed by LOVALLY from and on the devices and equipment you use to access the Application. This technical data informs us about :

 

  • The IP address ;

  • The mobile or device identifier ;

  • The version of the application ;

  • The model and operating system of the mobile or device ;

  • The language used ;

  • Information about crashes affecting the Application;

  • Advertising identifiers.

 

2.3.                  Data related to transactions

 

LOVALLY does not collect or process any banking data.

 

Payments are managed exclusively by:

 

  • The Apple App Store;

  • The Google Play Store.

 

These platforms do not share payment method data with LOVALLY. Only certain technical data is exchanged, such as a transaction identifier, to validate the purchase, but this technical data does not allow for identification.

 

LOVALLY therefore keeps your purchase history but does not retain any information regarding payment methods.

 

3.         Purposes and basis for processing your personal data by LOVALLY

 

In the context of operating the LOVALLY application, we collect and process your personal data for specific, explicit, and legitimate purposes, in accordance with the applicable data protection regulations, including the GDPR, the Belgian law of July 30, 2018 on the protection of individuals with regard to the processing of personal data, and the law of June 13, 2005 on electronic communications.

 

Each processing of data is based on a legal basis defined in Article 6 of the GDPR. Below is a summary table of the purposes for which your data is processed, as well as the legal grounds on which LOVALLY relies for each of these processes:

Withdrawal of consent and effects

 

When the processing of your personal data is based on your consent, you have the right to withdraw it at any time, without affecting the lawfulness of the processing based on consent before this withdrawal. This withdrawal can be exercised by contacting us using the contact details mentioned in the "Contact" section below.

 

The withdrawal of consent only results in the cessation of the processing concerned for the future. LOVALLY remains entitled to retain proof of processing carried out prior to the withdrawal, in compliance with its legal and contractual obligations.

 

 

4.         Cookies and trackers

 

Cookies may be used on our website for technical purposes, advertising purposes, and for audience measurement. On the Application, trackers may be used for technical and analytical purposes. To find out more, please consult our Cookie Use Charter [LINK]. 

 

5.         Are your data shared ?

 

Only certain employees of our customer service as well as duly authorized representatives of LOVALLY have access to the personal data of Application users, and only for the purposes described above. These persons can only consult the data strictly necessary for their functions.

 

Duly identified and reliable service providers and partners may also access and/or process the personal data of users on behalf of LOVALLY, in accordance with its Privacy Policy. These subcontractors of LOVALLY undertake to ensure the security and confidentiality of said data. Their intervention contributes to the proper functioning and improvement of LOVALLY's services, particularly in the following areas:

 

·       Technical infrastructure and data hosting (referring to those of our subcontractors responsible for infrastructure and data hosting);

·       Data analysis (referring to our software analysis providers);

·       Technical support to ensure optimal use of the Application (referring to our technical service providers for the use and proper functioning of the Application);

·       Customer service, in order to provide the required assistance and manage reports;

·       Marketing actions, in order to disseminate relevant offers, messages, and content to LOVALLY users and third parties (referring to our marketing partners) ;

In addition, LOVALLY may be required to transmit personal data of its users to public bodies, including judicial authorities, in response to legal obligations or official injunctions.

 

Finally, your personal data may be transferred in the event of transactions related to the life of the company, such as – without this list being exhaustive – a restructuring, a change of control, a merger, an acquisition, a transfer, or dissolution.

 

6.         Are your data transferred outside the EEA ?

 

Your personal data, collected and processed in the context of the use of the Application, are hosted within the European Union.

 

However, some of this data may be transmitted to LOVALLY subcontractors established outside the European Economic Area, in particular for services related to hosting, user assistance, report management, as well as advertising and marketing activities.

 

If transfers take place to countries that do not benefit from an adequacy decision from the European Commission regarding the protection of personal data, then LOVALLY commits to ensuring that such transfers are framed by appropriate safeguards ensuring a level of protection compliant with the applicable regulations. In particular, such transfers are governed by the standard contractual clauses adopted by the European Commission, to ensure security and confidentiality of personal data.

7.         What are your rights regarding your data and how to exercise them ?

 

Your rights in brief

 

In accordance with the GDPR, each user of the Application has the right to access, rectify, and, if applicable, the right to portability and erasure of their personal data, as well as the right to object to the processing or its limitation and the right to lodge a complaint with the competent national data protection authority.

 

Concerned about the users' issues regarding its Application, LOVALLY is committed to respecting personal data protection and to addressing requests related to the exercise of rights in an expedient manner and, in all cases, in compliance with legal deadlines.

 

How to exercise your rights?

 

Users can exercise their rights, subject to proving their identity, by exercising their rights directly from the Application, by sending an email to dpo@lovally.com or by sending a letter to the following postal address: LOVALLY, attention of the Data Protection Officer, BE-1000 Brussels, avenue de Vilvorde, 100. For confidentiality reasons, in case of doubt about the identity of the requester, proof of identity may be requested.

Final remarks

 

These rights can be exercised within the limits of LOVALLY's technical means, particularly when some data is transmitted or synchronized with third-party services, such as Apple or Google. In this case, the cooperation of these platforms may be necessary to process certain requests (particularly the rectification of certain data).

 

8.         How long do we keep your data ?

 

LOVALLY has implemented an automatic deletion process for Users' Accounts and personal data, in compliance with the retention periods defined below. When certain data must be retained for statistical purposes beyond these deadlines, they are anonymized irreversibly, making any identification impossible.

 

8.1.                  Retention during the duration of use of the Application

 

Personal data are retained for the entire duration of active use of the Application, namely:

  • For the duration of the user's registration increased by twelve (12) months. In case of continuous inactivity of an account for twelve (12) months, it is automatically deleted. An Account is considered inactive when the Application no longer establishes communication with LOVALLY's servers (for example, due to the deactivation of geolocation) and the user no longer uses it actively.

  • As an intermediary service provider and operator of a personal communications service not based on numbering, LOVALLY remains bound, even after account deletion, to respect various legal obligations requiring retention of certain personal data for varying periods.

 

8.2.                   In case of account termination by LOVALLY

 

When a user is banned from the Application, their account is deactivated. Related data are retained for the duration necessary to comply with the various legal obligations incumbent on LOVALLY, in accordance with the retention periods provided for by these same obligations.

 

8.3.                  Deletion at the user's initiative

 

When a user deletes their account themselves, or requests deletion from LOVALLY's customer service, it is immediately deactivated and removed from the Application. However, certain personal data may be retained, in accordance with the legal obligations incumbent on LOVALLY and for the durations provided by these obligations.

 

8.4.                   Geolocation data

 

Geolocation data collected by our partner Devside are retained for 12 months.

This duration allows LOVALLY to identify potential meetings between users and to propose compatible profiles in the Application.

 

 

8.5.                  Data security

LOVALLY commits to implement all reasonable technical and organizational means to ensure an optimal level of security for the collected, processed, and retained data. However, it is up to each user to take the necessary measures to protect their own personal information (e.g.: strong password, confidentiality of the device used, etc.).

 

9.         Protection of minors

 

LOVALLY strictly refuses to collect personal data concerning minors. Access to the Application is exclusively reserved for individuals aged 18 or over.

 

In case of false declaration by a user regarding their date of birth – notably if they fraudulently claim to be an adult – the parents or legal representatives of the minor child are invited to immediately inform LOVALLY by sending an email to one of the email addresses mentioned in Article 10 "Contact".

 

LOVALLY commits to proceed, as soon as possible, to the complete deletion of personal data relating to the concerned minor child, upon receipt of this request and after appropriate verification of the situation.
